TERMS AND CONDITIONS OF SALE

  1. All bidders are required to register prior to the sale and must produce a valid driver’s license or other personal identification in order to bid. Bidders must use the bidder number assigned to them at the time of registration.
  2. The Auctioneer reserves the right to accept or reject any bid and shall control the bidding at all times. The Auctioneers also reserves the right to withdraw, consolidate or divide any lot or lots in the auction. In all cases of dispute the Auctioneer’s decision shall be final.
  3. Terms of the sale are Cash or other approved equivalent. Full settlement must be made on sale day. Nothing may be removed until paid for in FULL, including any and all storage charges. Items purchased through absentee bids, internet bids, telephone bids, or any other method of proxy bidding will be invoiced immediately after the auction and charged to the credit card information on file at the time of registering the bid.
  4. All items are sold on an “as-is” and “where-is” basis with no guarantees, warranties or representations express or  implied, with respect to the correctness, descriptions, authenticity, advertisement, physical condition, size, quantity, quality, or value of any goods offered for sale. All items lie at the purchaser’s risk immediately at the fall of the hammer or the word sold. Any subsequent damage, including any caused by the auction staff during moving or loading is solely at the buyer’s risk.
  5. All items have been displayed and each purchaser shall be held to have satisfied themselves as to the authenticity, advertisement, physical condition, size, quantity, quality, or value of any goods offered for sale, and shall not be entitled to make any objection after the sale whatsoever. The consignor, the Auctioneer or any Employee of the Auctioneer, do NOT have any authority to make any representation or warranty regarding an item.
  6. On no account is a consignor of goods to the auction allowed to bid on their own merchandise.
  7. Some of the items may have a reserve price below which the Auctioneer will not sell the item, although on occasions the bidding may start below the reserve, the Auctioneer may execute bids on behalf of the consignor to protect the reserve, if applicable. The Auctioneer, at his discretion, may not sell any unreserved item, if, in his judgment, the highest bid is at a level that could be considered injurious to the consignor.
  8. All sales are final. No refunds or credits shall be issued under any circumstances, and No returns will accepted under any circumstances. The Auctioneer reserves the right to revoke the sale of any item even if the item has been paid for in full and removed from the premises. The Buyer will surrender such item to the Auctioneer for a full refund of the purchase price and compensation for moving of the item at a fair market rate.
  9. All items must be picked up within one day following the auction or moving charges of $150 per hour and storage charges of $50 per item per day will be assessed. When the fees on any item exceed $250 the item will be considered abandoned and disposed of appropriately with additional fees of $150 per hour for moving and any dumping fees that are incurred. In all cases the buyer is responsible for any and all of these additional fees.
  10. There will be an additional 10% buyers Fee charged on all items sold unless otherwise announced by the Auctioneer prior to the sale of the item.
  11. There will be an additional 5% GST charged on all items and fees.
